What this Act covers

The Immigration and Social Security Coordination (EU Withdrawal) Act ended free movement between the UK and the EU. This means that EU, European Economic Area and Swiss citizens are subject to UK immigration law.

Why we are involved

The Act provided an opportunity to improve treatment in the immigration system and strengthen the UK's commitment equality and human rights law. Our input focused on immigration detention and access to public services.

Our recommendations

The Government should:

  • put an end to indefinite detention and introduce a 28-day limit
  • set out legal criteria for detaining people only as a last resort
  • prevent data-sharing between public services and immigration enforcement so that migrants can access essential services like health, education and the police
