What is the consultation for?

The consultation sets out some of the proposals for change to mental health and incapacity law put forward by the Scottish Mental Health and Incapacity Law Review.

Why have we responded to the consultation?

We believe that this review must ensure that any legislative changes to mental health law have equality and non-discrimination at their heart.

Our recommendations

We re-emphasised the need for the review to account for, and ensure that their proposals complement the equality legal framework. We also supported the call for specialised independent advocacy to meet the needs of those sharing different protected characteristics and highlighted the importance of adequate data collection to understand people’s experiences in relation to the provision of advocacy services.
